Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets forth the rules and permissible conduct for using the network proxy, secure tunnels, and related services (“Services”) offered by ATOER. By using or continuing to use our Services, you (“Customer,” “you,” or “your”) agree to comply with this AUP and acknowledge responsibility for all activities carried out under your account. Violations of this AUP may result in suspension, termination, or other actions as deemed necessary by ATOER. We reserve the right to amend this AUP at any time; such changes become effective upon posting on our official website.

1. Prohibited Uses

You may not use (or allow others to use) the Services in ways that are unlawful, harmful, or disruptive. Prohibited activities include but are not limited to:

  • Illegal Activities: Any activity violating local, national, or international laws, such as cybercrime, intellectual property infringement, data privacy violations, or financial misconduct.
  • Fraudulent or Harmful Content: Uploading, posting, hosting, or transmitting material that is fraudulent, defamatory, harassing, hateful, or otherwise objectionable, including content promoting discrimination or violence.
  • Child Exploitation or Pornography: Possessing, distributing, or facilitating any content involving the sexual exploitation of minors or that violates child protection laws.
  • Spam and Unsolicited Communications: Sending or facilitating unsolicited bulk messages (“spam”), phishing attempts, chain letters, or other forms of abusive e-communications.
  • System or Network Abuse: Hacking, unauthorized network access, denial-of-service (DoS) or distributed DoS (DDoS) attacks, port scanning, or any interference with systems or networks without owner consent.
  • Facilitating Illegal Transactions: Activities relating to money laundering, illegal gambling, terrorism financing, or trading of illicit goods or services.
  • Unauthorized Proxy or Relay: Running open proxies, public relay endpoints, TOR exit nodes, or other services that risk misuse and potential IP blacklisting.
  • Malware Distribution: Uploading, transmitting, or distributing computer viruses, worms, spyware, ransomware, or other harmful code intended to disrupt or damage systems or data.

2. Resource Use

ATOER’s infrastructure is a shared environment. You must not use the Services in a way that negatively impacts the network performance or the experience of other users. Examples of improper resource usage include:

  • Excessive Consumption: Continuously running processes that heavily tax CPU, memory, or bandwidth resources, degrading server or network performance.
  • Cryptocurrency Mining: Employing the network proxy or secure tunnels for cryptocurrency mining or similar intensive computational tasks, unless explicitly authorized by ATOER.
  • Misconfigured Tools: Running software or scripts (e.g., packet injection, network acceleration tools) that cause unusual traffic patterns or congestion affecting other users.
  • Unauthorized Scanning: Using scanning or penetration testing tools on external hosts without the explicit written consent of the targeted system’s owner.

3. Security Violations

You are responsible for maintaining the security of your account. Any action that compromises or attempts to compromise the security of ATOER’s infrastructure or third-party systems is strictly prohibited. This includes:

  • Unauthorized Access: Attempting to bypass authentication mechanisms or access systems and data without explicit permission, including using stolen credentials or exploiting software vulnerabilities.
  • Data Interception: Sniffing network traffic or eavesdropping on data you are not authorized to view, or capturing data packets intended for other users without their consent.
  • Penetration Attempts: Probing, scanning, or testing network security for vulnerability exploitation without the necessary authorization.

4. User Responsibility

You are responsible for all activities that occur under your account. To ensure compliance with this AUP, you agree to:

  • Keep Credentials Secure: Protect your usernames, passwords, and keys against unauthorized access. Sharing them with untrusted parties is prohibited.
  • Ensure Policy Compliance: Communicate this AUP to all individuals using the Services under your account and supervise their actions accordingly.
  • Report Incidents: Notify ATOER immediately of any suspected security breach, unauthorized usage, or compromise of your account or our infrastructure.
  • Adopt Best Practices: Implement basic cybersecurity measures (e.g., encryption, firewalls, antivirus software) on your own systems to prevent abuse or compromise when connecting to our Services.

5. Suspension and Termination

ATOER may, at its sole discretion, suspend or terminate your use of the Services if you or your end users breach this AUP or otherwise pose a risk to our infrastructure or the interests of other customers. Actions that might lead to immediate suspension or termination include:

  • Evidence of illegal or harmful activities as outlined in Section 1.
  • Repeated misconduct or non-compliance after prior warnings.
  • Engaging in severe security violations threatening the stability of our network.

Where possible, we will endeavor to provide you with notice and an opportunity to address the violation. However, in critical scenarios requiring urgent measures, we may act without prior notice to maintain service integrity and legal compliance.

6. Reporting Violations

7. No Spam Policy

ATOER adopts a strict no-spam stance. You may not use our network proxies, tunnels, or any related resources to send unsolicited bulk messages, facilitate spam campaigns, or promote phishing schemes. If your account is found to be engaged in spam, it may be immediately suspended or terminated. You may also be liable for associated damages, including reputational harm or blacklisting costs incurred by ATOER.

8. Legal Compliance

You are required to comply with all applicable laws and regulations, including those pertaining to data privacy, export controls, intellectual property, and online communications. ATOER may disclose account details or user data to law enforcement agencies or judicial bodies if required by law, or if we believe such disclosure is necessary to protect our rights, comply with legal obligations, or safeguard other users.

9. Indemnification

You agree to indemnify, defend, and hold harmless ATOER, its officers, employees, affiliates, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your breach of this AUP, misuse of the Services, or violation of the rights of any third party.

10. Modifications to the AUP

ATOER reserves the right to update or change this AUP at any time. Any amendments will be posted on our official website and become effective upon posting. Your continued use of the Services signifies your acceptance of any revised terms. If you do not agree to the changes, you should discontinue your use of the Services before they take effect.
